Introduction

These Terms and Conditions govern your access to and use of the MyKasi platform, website, property listing services, project listing services, applications, communications, and related services (“the Platform”). By accessing or using the Platform, you agree to comply with these Terms and Conditions.

1. Definitions

“Platform” refers to the MyKasi website, systems, software, applications, listing infrastructure, and related services.

“User” refers to any individual, company, developer, agency, broker, investor, property owner, project owner, or entity using the Platform.

“Material” includes all text, images, videos, documents, graphics, advertisements, project information, and listing information uploaded to the Platform.

2. Nature of the Platform

MyKasi is an online property and projects listing platform designed to advertise properties, market developments, showcase projects, and provide commercial exposure for listings.

MyKasi:

• is not an estate agency unless otherwise stated;
• is not a financial institution;
• is not an investment advisor;
• is not a conveyancer or legal advisor;
• does not guarantee sales, rentals, buyers, tenants, partnerships, or project success.

3. Terms of Use

Users may not:

• upload unlawful, misleading, fraudulent, or defamatory material;
• infringe intellectual property rights;
• interfere with Platform security or operations;
• use bots, scrapers, or automated systems to copy Platform data;
• attempt unauthorised access to systems or accounts.

4. Property and Project Listings

Users may only submit listings where they are:

• the lawful owner;
• authorised by the owner; or
• acting as a duly authorised representative.

Users are solely responsible for:

• the accuracy of listing information;
• uploaded images and material;
• pricing and availability information;
• compliance with applicable laws.

MyKasi reserves the right to review, reject, edit, suspend, or remove listings at its sole discretion.

5. Prohibited Content

Users may not upload content that:

• is false or misleading;
• contains discriminatory or unlawful material;
• infringes third-party rights;
• contains manipulated or deceptive images;
• advertises unavailable properties or projects.

6. Fees and Payments

MyKasi reserves the right to charge:

• listing fees;
• advertising fees;
• featured listing fees;
• subscription fees;
• marketing or promotional fees.

7. Copyright and Intellectual Property

All trademarks, branding, software, graphics, databases, content, and technology forming part of the Platform remain the intellectual property of MyKasi or its licensors.

By uploading material to the Platform, users grant MyKasi a non-exclusive, royalty-free licence to publish, market, display, and distribute such material for purposes related to operating and promoting the Platform.

8. Privacy

MyKasi may collect, process, and store personal and business information for purposes related to operating the Platform and delivering services in accordance with applicable South African laws, including POPIA where applicable.

9. Disclaimer

The Platform contains listings and advertisements published by third parties. MyKasi does not verify all information uploaded by users and does not guarantee the accuracy, completeness, or reliability of listings.

10. Limitation of Liability

MyKasi shall not be liable for:

• financial losses;
• property transaction disputes;
• loss of profits or opportunity;
• business interruption;
• data loss;
• project failures; or
• consequential damages arising from use of the Platform.

11. Indemnity

Users indemnify and hold harmless MyKasi against all claims, liabilities, damages, losses, and legal costs arising from:

• their use of the Platform;
• their listings or uploaded content;
• breaches of these Terms;
• disputes with third parties.

12. Termination

MyKasi may suspend or terminate access to the Platform where:

• these Terms are breached;
• unlawful conduct is suspected;
• fees remain unpaid; or
• user conduct poses operational or reputational risk.

13. Governing Law

These Terms and Conditions are governed by the laws of the Republic of South Africa. Any disputes arising shall fall within the jurisdiction of South African courts.
